Slip and Fall Accident Lawyer

A personal injury case where a person has fallen, slipped, or tripped on someone else’s property is called a “slip and fall.” Most slip and fall cases are usually titled under a premises liability claim. Many slip & fall accidents happen on a property/premises that is maintained by somebody else (owner) who may be held legally responsible for being the owner of the property.

Determining the fault of a slip and fall accident

Usually in slip and fall accident cases, the injured person will need to prove that the cause of said accident was due to a dangerous condition on the owner’s behalf and that the owner knew about the dangers prior to the incident. Having a “dangerous condition” on a property would present a high risk to a person on the property, and the injured person should not have expected the injury to happen.

It is hard to determine a case in which someone else should be held liable for your injures if you happen to injury yourself by slipping or tripping. All cases are different and depends on if the owner of the property made certain of a slip or fall not to happen, or if the injured person was being careless. Conditions that may make a property dangerous includes poor lighting, narrow stairways, wet floors, a change in flooring, or even carpeting that is torn. Even more types of slip & fall accidents occur publicly when people have tripped on a cracked sidewalk, or on stairs and escalators.

The owner of the property must have known previously that a dangerous condition occurred on their premises, and be proven that the owner either knew it existed and didn’t correct the problem; created the problem/condition; or the condition had been existent for awhile and should have addressed the problem prior to a slip or fall incident happening. If a person is to fall because they were looking away and not in front of them while walking, that person will not be able to file a claim against the owner of a property if in no way the owner was at fault for the injury – no matter how serious it might have been.
